Terms of Use and Privacy Policy

This Terms of Use and Privacy Policy describes how data from users is collected, processed, and shared. It also directs and limits responsibility for treatment and care decision to the licensed provider from whom direct treatment is received.  

Personally identifiable information of website visitors is generally not held or stored by the provider of the application. Information which cannot be linked to an individual user is collected and used for purposes including refinement of the logarithm upon which the app is based, improvement of app performance, and monitoring of safety issues.  The identifiable information of visitors to or users of this website is not recorded or maintained by the provider of the app.   Whether an individual is using the app, or is or is or is not subscribed to it, shall not be recorded.  Personally identifiable information remains solely in the custody and possession of the licensed provider under whose treatment the person using the app.  Such licensed provider is solely responsible to maintain confidentiality as required by law.

All patient data is de-identified before being entered into the algorithm contained within the app platform.  De-identified data will be anonymously stored in a data lake which cannot under any circumstances be traced back to an individual.  De-identified data may be accessed for the purpose of population studies and to improve the performance of the app.

All treatment is administered under the supervision of the licensed provider designated by the patient. Fertility Basics will not be held responsible for treatment received from the licensed provider. The designated licensed provider remains solely responsible for all patient care and for the guarding of confidentiality.

Because use of the app may involve medical diagnosis, treatment, and decision making, access to the app platform is strictly limited to persons being directly treated by and under the supervision of a licensed provider, as designated by the patient.  All diagnoses and treatment decisions are the sole responsibility of the treating provider.  As the app is based on using the results of direct treatment, it provides suggestions only, and these should not be considered as definitive. 

The outcome of treatment shall remain anonymous and confidential.  Individual results will be used and shared only with the permission of the patient and provider.

Providers and patients agree to these terms as a condition of using the app.  No person other than the Medical Director of the app provider can alter these terms.  Any claim against the provider of the app for the outcome of treatment through the app is hereby irrevocably waived.  The circumstances and medical histories of patients will not be known to the app provider, for which reason, the provider cannot accept responsibility for anything that happens as the result of treatment.
